"Facelift"

Nordic Law Blog – which I initiated earlier this year, has received a “facelift”. Nordic Law Blog now follows 20 Nordic blogs, and approximately 45 blogs outside Scandinavia . Nordic Law Blog still brings together blogs and sites that cover legal affairs and developments – hopefully cases, articles, personalities and trends of interest to Lawyers and to the community.

Our blog roll gives you a selection of blogs from Nordic countries, Europe and the US; however the selection makes no claim to be exhaustive.

Hopefully you will find some entries interesting, and return to this page regularly for updates. Feel free to suggest blogs relevant for Nordic Law Blog – suggestions are welcome.

Piska för all del, men ingen lemlästning: Några tankar kring den s.k. BDSM-domen

Mårten Schultz: Hovrättsdomen i det s.k. BDSM-målet som kom för någon vecka har kommit att utgöra en ideologisk vattendelare....Vad som hade hänt är i det stora hela klarlagt. En sextonårig tjej* hade frivilligt (tills vidare i vardagsspråklig, inte juridisk mening) inlåtit sig i sexuellt umgänge av sado-masochistiskt slag med en 32-årig man. Den behandling som mannen utsatte kvinnan för skulle i vanliga fall vara att betrakta som misshandel, av normalgraden. ...Den stora frågan i målet var om ett ansvarsbefriande samtycke förelegat.

Den debatt som följt av domen har präglats av ideologiska positioneringar. .. I botten ligger två stora frågor.
1: I vilken utsträckning skall en människa anses kunna samtycka till att bli utsatt för gärningar, eller risker för gärningar, som vanligtvis betraktas som kränkande?
2: Hur bör juridiken förhålla sig till den värdering som görs under fråga 1?

Ingenting er mer subjektivt enn sannheten

"Mange tror nok at tvistene for domstolen som regel gjelder tolking av vanskelige juridiske regler. Sånn er det ikke. Tolkingen av regelen skaper sjelden de store problemene. Nei, kampen i domstolen står om faktum. Hvilket faktum skal legges til grunn?

Noen lever i den villfarelse at det alltid er mulig å finne et objektivt og sant faktum. Sånn er det heller ikke. I alle fall ikke faktum som er knyttet til folks observasjoner og opplevelser."

Consumer Rights Directive approved by Council

"The EU’s Council of Ministers approved the new Consumer Rights Directive on 10 October 2011. Member States now have two years to implement the Directive". Read more: European Privat Law News from The University of Edinburgh Law School.

"På Juristforbundets Rettsikkerhetskonferanse sist uke var det oppe til debatt om juristenes etikk var samfunnsskadelig, blant annet under henvisning til at vi har et samfunnssystem som verner seg selv, og ikke nødvendigvis vårt “rettsamfunn“. Som en del av dette har vi “jurister som produserer avgjørelser og ikke rettferdighet”. "

Skattelister, offentlighet og personvern – noen juridiske refleksjoner

John Wessel-Aas skriver denne uken om offentliggjøring av skattelister i Norge og personvern.

"Igjen er det den tiden på året da skatteoppgjøret – regnskapet mellom fellesskapet og den enkelte skattyter – er klart, og hver og én får informasjon om sitt eget oppgjør.
I motsetning til i mange land i Europa, har opplysninger om (grovt sagt) skattbar inntekt, innbetalt skatt og skattbar formue for hver enkelt skatteyter, i mange år vært offentlig tilgjengelig informasjon i Norge."

Demokrati, yttringsfrihet og terror

Flere bloggere har de siste ukene reflektert over terrorsaken og aktuelle spørsmål som reiser seg i tilknytning til sårbarhet i et moderne demokrati. Terror kan lett utløse krav om strengere regulering.

Magnes Blogg skriver om Sorgmelding som kommentar til problematiseringen av sykemeldinger. John Wessel Aas skriver om å møte terror med mer demokrati og åpenhet - og da er kanskje ikke økte fullmakter til overvåkingstjenesten veien å gå? Olav Torvund tar opp dis­ku­sjo­nen om ano­nyme nett­de­bat­ter som har blus­set opp igjen. Det er en vik­tig og vans­ke­lig debatt med utgangspunkt i yttringsfriheten. Runar Lium reflekterer i Dommerbloggen over om ikke domstolloven § 133 kan være en nyttig ledesnor for den poltiske debatten. Dealing with Your Incompetent Boss

One of the blogs followed by Nordic Lawyers gives straightforward, actionable advice for novice managers, seasoned leaders, and people at all levels in between. Last week Amy Gallo, a contributing editor at Harvard Business Review, wrote about "Dealing with Your Incompetent Boss".

"Everyone complains about his or her boss from time to time. In fact, some consider it a national workplace pastime. But there's a difference between everyday griping and stressful frustration, just as there is a clear distinction between a manager with a few flaws and one who is incompetent. Dealing with the latter can be anguishing and taxing. But with the right mindset and a few practical tools, you can not only survive but flourish."

Working with a page and an account together you can make your Facebook presence and marketing opportunities even stronger than before"

Lawyers Life shares thoughts about how to quit your job without burning your bridges. "Quit with a smile. Give a decent amount of notice. Don't forget the bonus. Keep busy until you leave and finally - suggestions - how to handle that exit interview?"

iPhone J.D (Lawyers using iPhone) gives updates for Lawyers using iPhone and other gadgets -this week the iPad 2. TopLawyerCoach, Legal Business Development and Legal Marketing blog discuss issues such as “4 ways to manage Clients expectations”, “How to improve the management of legal teams” and “How satisfied are your clients? Ask them”.

The International Bar Association and Opinio Jure this week addresses Libya.

The International Bar Association : Justice for Libya: Local or ‘international’ - "At present, the future of the North African country hangs in the balance. Gaddafi’s forces are marching on Benghazi, the central hub of the resistance movement, while the international community tears through the final layers of red tape to give planes the go-ahead to take to the skies. Few believe the struggle will be easy. But win or lose, should Gaddafi survive the conflict, he may find himself facing legal action for his aggressive stance against the Libyan people. The International Criminal Court (ICC) has already opened an investigation into alleged crimes against humanity committed since 15 February, and the Prosecutor has said he hopes to make an arrest warrant within the next few months".

Opinio Jure - Libya and the Three models of the Security Council.
The author discusses ways in which the Security Council might function, for some given situation, in regards to international peace and security. The three modes discussed are: "The Security Council as the “management committee of our fledgling collective security system"... as the “concert of the nations ... or as the “talking shop of the nations .. Moreover, if the world is in fact becoming more multipolar, one might expect the Security Council to have fewer, not more possibilities, for being the “management committee” or the “concert of nations.” A multipolar world is more intensely competitive, not cooperative ... It tends toward the last of these three modes, not the first two."
